1. Company Structure
Web It Over operates as an independent business based in Ohio. Services may be performed by the Company owner and/or independent contractors, subcontractors, or team members engaged by the Company at its discretion.
2. Scope of Services
Services are provided on a project-by-project basis and are defined in written proposals, invoices, or agreements.
Any work requested outside the agreed scope may require additional fees and written approval.
3. Deposits & Payment Terms
A non-refundable deposit is required before any project begins.
The deposit secures:
- Project scheduling
- Strategic planning
- Research
- Initial design and development work
Remaining balances must be paid according to the agreed payment schedule.
Failure to complete payment may result in:
- Suspension of work
- Withholding of final deliverables
- Website not being transferred or launched
All payments are final unless otherwise agreed in writing.
4. No Refund Policy
All deposits and payments are non-refundable.
Due to the time, strategy, creative development, and technical execution involved in each project, refunds will not be issued once work has commenced.
Chargebacks or payment disputes initiated without cause will be considered a breach of this Agreement.
5. Client Responsibilities
Clients agree to:
- Provide accurate information
- Deliver requested content and materials in a timely manner
- Ensure they have proper rights to all provided materials
- Provide feedback within reasonable timeframes
Project delays caused by the client do not warrant refunds.
6. Intellectual Property
Upon full payment, the client receives rights to the final approved website design and agreed deliverables.
Until full payment is received, all work remains the property of Web It Over.
Web It Over reserves the right to display completed work in portfolios, marketing materials, and promotional content unless otherwise agreed in writing.
7. Limitation of Liability
Web It Over shall not be liable for:
- Loss of revenue
- Business interruption
- Data loss
- Security breaches
- Third-party hosting issues
- Plugin or software conflicts
- Search engine performance
- Indirect or consequential damages
Total liability shall not exceed the total amount paid for services.
8. Third-Party Platforms
Web It Over is not responsible for performance, outages, pricing changes, or issues related to:
- Hosting providers
- Domain registrars
- Plugins
- Payment processors
- External software
Clients are responsible for maintaining active third-party subscriptions unless otherwise agreed.
9. No Performance Guarantees
We do not guarantee:
- Increased traffic
- Increased revenue
- Specific SEO rankings
- Lead volume
- Business growth
Results depend on factors outside our control.
10. Project Abandonment
If a client becomes unresponsive for 30 days or more, the project may be considered abandoned. No refunds will be issued for abandoned projects.
11. Termination
We reserve the right to terminate services if:
- Payments are not made
- Terms are violated
- The client engages in abusive or inappropriate conduct
No refunds will be issued in such cases.
12. Governing Law
This Agreement shall be governed by the laws of the State of Ohio.
13. Modifications
We reserve the right to update these Terms at any time. Updated versions will be posted with a revised effective date.
14. Agreement Acknowledgment
By engaging our services, submitting payment, or signing a proposal, you acknowledge that you have read, understood, and agreed to these Terms of Service.
